សិក្ខាសាលាស្ដីពី «ការគណនាសំណងការខូចខាត៖ ករណីមិនអនុវត្តកាតព្វកិច្ចតាមកិច្ចសន្យា»

នារសៀល ថ្ងៃអង្គារ ៤រោច ខែស្រាពណ៍ ឆ្នាំមមី អដ្ឋស័ក ព.ស. ២៥៧០ ត្រូវនឹងថ្ងៃទី១ ខែកញ្ញា ឆ្នាំ២០២៦ លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានចាត់តាំង លោកមេធាវី លី សុខឡាយ សមាជិកក្រុមប្រឹក្សាគណៈមេធាវី អញ្ជើញជាអធិបតី និងថ្លែងសុន្ទរកថាបើកសិក្ខាសាលាស្ដីពី «ការគណនាសំណងការខូចខាត៖ ករណីមិនអនុវត្តកាតព្វកិច្ចតាមកិច្ចសន្យា» ដែលសហការរៀបចំដោយគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា និងមជ្ឈមណ្ឌលជាតិនៃមជ្ឈត្តការផ្នែកពាណិជ្ជកម្ម។ កម្មវិធីនេះ ក៏មានការអញ្ជើញចូលរួមថ្លែងមតិចំណាប់អារម្មណ៍ដោយលោកស្រីមជ្ឈត្តករ លឹម រដ្ឋា អនុប្រធានមជ្ឈមណ្ឌលជាតិនៃមជ្ឈត្តការផ្នែកពាណិជ្ជកម្ម តំណាងលោកមជ្ឈត្តករ ហ៊ឹប ណារិទ្ធិ វេស៍ ប្រធានមជ្ឈមណ្ឌលជាតិនៃមជ្ឈត្តការផ្នែកពាណិជ្ជកម្ម (ម.ជ.​ម.) និងមានការអញ្ជើញចូលរួមជាវាគ្មិនកិត្តិយសពីលោកមេធាវី អ៊ីវ ប៉ូលី ប្រធានគណៈកម្មការកិច្ចការរដ្ឋប្បវេណីនៃគណៈមេធាវី និងលោកមជ្ឈត្តករ កុយ នាម អតីតក្រុមប្រឹក្សាប្រតិបត្តិនៃម.ជ.ម. ព្រមទាំងមានការចូលរួមពីថ្នាក់ដឹកនាំនៃអគ្គលេខាធិការដ្ឋានគណៈមេធាវី ថ្នាក់ដឹកនាំមជ្ឈមណ្ឌលបណ្តុះបណ្តាលវិជ្ជាជីវៈមេធាវី ក្រុមការងារ ម.ជ.ម និងសិក្ខាកាមចូលរួមដោយផ្ទាល់សរុបប្រមាណ ២០០នាក់។ សិក្ខាសាលានេះធ្វើឡើងក្នុងគោលបំណងផ្តល់ឱ្យសិក្ខាកាមនូវការយល់ដឹងបន្ថែមអំពីលក្ខខណ្ឌនៃការទទួលខុសត្រូវក្នុងការសងសំណងការខូចខាត ក្នុងករណីមិនអនុវត្តកាតព្វកិច្ចតាមកិច្ចសន្យា ព្រមទាំងស្វែងយល់អំពីការខូចខាតដែលកើតឡើងពីកំហុស ទាំងដោយចេតនា និងដោយអចេតនា និងទំនាក់ទំនងហេតុ និងផលនៃការសងសំណង។ លើសពីនេះ សិក្ខាកាមនឹងបានស្វែងយល់អំពីទំហំនៃការខូចខាត ដែលរួមមានការខូចខាតជាទ្រព្យសម្បត្តិ និងការខូចខាតមិនមែនជាទ្រព្យសម្បត្តិ ព្រមទាំងប្រភេទនៃការខូចខាតនីមួយៗ ដើម្បីពង្រឹងចំណេះដឹង និងសមត្ថភាពក្នុងការអនុវត្តវិជ្ជាជីវៈមេធាវី។ ខ្លឹមសារនេះស្របតាមការលើកឡើងក្នុងសុន្ទរកថាបើក ដែលផ្តោតលើលក្ខខណ្ឌនៃការទទួលខុសត្រូវ ទំនាក់ទំនងហេតុ និងផល និងការកំណត់ទំហំនៃការខូចខាត។ ជាចុងបញ្ចប់នៃកម្មវិធី លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានចាត់តាំង លោកមេធាវី ឃុត កែវសុត្ថា សមាជិកក្រុមប្រឹក្សាគណៈមេធាវី ថ្លែងសុន្ទរកថាបិទសិក្ខាសាលា។ ក្នុងឱកាសនោះ លោកមេធាវីបានកោតសរសើរដល់មជ្ឈមណ្ឌលជាតិនៃមជ្ឈត្តការផ្នែកពាណិជ្ជកម្ម ជាពិសេសវាគ្មិនកិត្តិយស និងអ្នកចូលរួមទាំងអស់ ដែលបានចំណាយពេលវេលាដ៏មានតម្លៃចូលរួមចែករំលែក និងស្វែងយល់ពីចំណេះដឹងថ្មីៗពាក់ព័ន្ធនឹងការគណនាសំណងការខូចខាត។ លោកមេធាវីបានបង្ហាញក្តីសង្ឃឹមថា កិច្ចសហប្រតិបត្តិការរវាងគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា និងមជ្ឈមណ្ឌលជាតិនៃមជ្ឈត្តការផ្នែកពាណិជ្ជកម្ម នឹងបន្តមានជាបន្តបន្ទាប់ ហើយចំណេះដឹងដែលទទួលបានពីសិក្ខាសាលានេះ នឹងក្លាយជាចំណេះដឹង និងឱកាសថ្មីមួយសម្រាប់ការប្រកបវិជ្ជាជីវៈមេធាវី។

Seminar on "Damage Calculation in the Event of Default"

On the afternoon of Tuesday, 1st September 2026, Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia, appointed Attorney LY Soklay, Member of the Bar Council, to preside over and deliver the opening remarks at the seminar on "Damage Calculation in the Event of Default," jointly organized by the Bar Association of the Kingdom of Cambodia and the National Commercial Arbitration Centre (NCAC). The event also featured remarks by Arbitrator LIM Ratha, Vice President of the National Commercial Arbitration Centre, representing Arbitrator HIB Narith West, President of the National Commercial Arbitration Centre (NCAC). The distinguished speakers included Attorney IV Poly, Chairperson of the Civil Affairs Committee of the Bar Association, and Arbitrator KOY Neam, former Executive Council Member of the National Commercial Arbitration Centre. The seminar was also attended by leaders of the General Secretariat of the Bar Association, leaders of the Lawyer Training Center, the NCAC working team, and approximately 200 participants attending in person. The seminar aimed to provide participants with a deeper understanding of the conditions for liability to pay damages in cases of non-performance of contractual obligations, as well as damages arising from both intentional and unintentional faults and the causal relationship in the assessment of damages. In addition, participants learned about the scope of damages, including property and non-property damages, as well as the different types of damages, with the aim of strengthening their knowledge and capacity in the legal profession. These topics were consistent with the key points highlighted in the opening remarks, particularly the conditions for liability, causation, and the determination of the extent of damages. At the conclusion of the seminar, Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia, appointed Attorney KHUTH Keosotha, Member of the Bar Council, to deliver the closing remarks. On this occasion, Attorney KHUTH Keosotha expressed his appreciation to the National Commercial Arbitration Centre, particularly the distinguished speakers and all participants, for taking the time to share and gain new knowledge on damage calculation. He expressed his hope that the cooperation between the Bar Association of the Kingdom of Cambodia and the National Commercial Arbitration Centre would continue in the future, and that the knowledge gained from the seminar would provide new knowledge and opportunities for the practice of the legal profession.
